Madison County Judge Frank Barger, has accepted a wrongful death suit against an Alabama abortion clinic. The lawsuit has been brought by Ryan Magers, the father of an aborted baby. According to the judge, Alabama “Person-hood” law recognizes a fetus as a person and Magers has legal standing to bring suit on behalf of his unborn child.

400 Year Old Science

Americans are beginning to question when exactly “Person-hood” begins, and many say it is about time. The science that under-girds the US legal definition of when a person becomes a person, is hundreds of years old. In Canada, one of only two countries on the planet that deems abortion legal without restriction at any time and for any reason, the definition of person-hood is based on science that is four hundred years old.

Twenty American States have passed legislation called the “Fetal Heartbeat Bill“. This law protects and bestows rights to a fetus once a heartbeat is detected. Supporters of this bill believe if a beating heart stops, a human life ends.

The rationale used to be that a fetus was just a clump of cells and was not really alive. Then science discovered that just how early fetal structures were forming and the morality became clouded. Then it was discovered that as early as five weeks a heart is beating confirming that whatever a fetus was, it was alive.

Then the argument changed to one of person-hood. The science could no longer be argued with, a fetus is alive, but it isn’t a person yet. This is something abortion supporters thought to be too subjective, certainly science could not give us a definitive answer. And if it can’t, then both sides must be humbled by ignorance and err on caution, err on no harm.

Science of Person-hood

Dianne Irving is a biochemisty and biology professor at Georgetown University who describes what happens at conception.

To begin with, scientifically something very radical occurs between the processes of gametogenesis and fertilization—the change from a simple part of one human being (i.e., a sperm) and a simple part of another human being (i.e.,… “ovum” or “egg”), which simply possess “human life,” to a new, genetically unique, newly existing, individual, whole living human being (a single-cell embryonic human zygote).

… upon fertilization, parts of human beings have actually been transformed into something very different from what they were before; they have been changed into a single, whole human being. During the process of fertilization, the sperm and the oocyte [egg] cease to exist as such, and a new human being is produced.¹

Science has come along way since the belief that a fetus was simply a clump of cells and a human cell was just a blob of protoplasm.

The baby’s heart starts to beat at around 6 weeks. You may be able to hear – and see – your baby’s heart beat for the first time when you’re about 8 weeks pregnant if you have an early ultrasound exam. [Thomas Moore, BabyCenter]

On even the most basic level, people agree that is something/someone has a heartbeat, they are alive, and if that heartbeat stops, a life has ended. In the video below the heartbeat is detected at five weeks.

Unfortunately abortion is so politicized that the baby is lost in the noise. Maybe because she has no voice and is easily drowned out by activists and their agendas. Maybe you noticed this simple instructional ultrasound has almost 900 dislikes at the time of this posting.

As science gets in the way of abortion politics, ultrasounds are at the top of the dislike list. There is a move in the United States requiring clinics to provide pregnant mothers with ultrasound images of their babies prior to any decisions. This legislation is being met with fierce opposition by pro-abortion groups and for good reason; there is no longer any doubt the abortion is ending the life of a human individual.

This absurd rhetoric could be due to the fact that the indiscriminate ending of a human fetal life is losing public support. A Gallup poll last July shows a majority of American’s  support abortion legislation.


In an era of claimed enlightenment and social justice, one of the above statistics above is frightening. 31% of American’s polled support ending the life up to and including a full term baby as it is being birthed.

When politician’s and society are unwilling to outlaw such a barbaric practice, how do we distinguish ourselves from those who declared Jew’s non humans in World War II, and those who legislated blacks as property?

One thing should be clear, the bible is as relevant to today’s human condition as any day in history. Humanity is still arrogant, violent, selfish and rebellious. People still have a need for love, meaning and acceptance. These basic characteristics of our humanity have not changed over the millennia and will not in millennia to come. Society cannot be trusted to discern morality by an ever changing popular vote, or even the minority vote as seen above.

Some of today’s claimed moral giants even fight against legislation to give preborn babies pain killers before they are dismembered by abortion.


Why Stop With Abortion?

In one of my other posts, I discuss Chicago University evolutionary professor Jerry Coyne’s view of infanticide.  On his blog [whyevolutionistrue] he argues for the morality of infanticide. In his controversial post he posed the question, if aborting a baby just before it is born is morally acceptable, then why isn’t killing a baby just after it’s born?

When you consider that today’s society sees the ending of an innocent human life for any reason, even seconds before being fully born and taking his/her first breath, something to fight for, you begin to realize humanities inability to govern its own morality.
